Illinois just took a big step to strengthen protections for residents with disabilities after a new bill was signed into law by the governor.

Landmark Legislation Elevates Disability Advocacy in Illinois

On Wednesday (6/17), Governor JB Pritzker signed House Bill 862 into law, creating the Illinois Department of Disability Advocacy and Guardianship (IDAG).

The new agency will elevate the work of the Illinois Guardianship and Advocacy Commission by transforming it into a cabinet-level department within state government.

State leaders say the move underscores Illinois' commitment to ensuring disability rights remain a top priority while expanding oversight and advocacy services for thousands of residents.

New Department Will Oversee Critical Services

According to Governor Pritzker's office, the department will continue providing essential support through three primary divisions.

The Division of State Guardian will serve as guardian of last resort for nearly 5,000 adults with disabilities across Illinois who require assistance and have no other suitable guardian available.

The Division of Legal Advocacy will continue offering legal representation in involuntary treatment and related court proceedings, while the Division of Disability Rights and Protections will investigate complaints and potential violations affecting Illinois residents with disabilities.

Governor Pritzker praised the legislation as a significant advancement for disability rights in Illinois.

Advocates also applauded the new Illinois law, saying it shows a long-term commitment to protecting our vulnerable residents.

The legislation also establishes a new Advisory Council made up of leaders from across Illinois who will provide guidance and input on the department's mission and priorities.

The Illinois Department of Disability Advocacy and Guardianship is scheduled to officially begin operations on July 1, 2027, positioning Illinois among the nation's leaders in disability advocacy, guardianship services, and rights protection.
