
New Social Media Fee Coming to Illinois in 2027
If you've heard that Illinois is getting a "social media tax," there's an important distinction to make: the fee is not a tax on you for doomscrolling.
This new tax is a fee imposed on certain social media platforms based on how many Illinois users they collect data from.
Again, this new social media fee is not a tax on you for scrolling TikTok, Facebook or Instagram.

Illinois enacted the new statewide Social Media Platform Fee through Senate Bill 3019, which was signed into law by Gov. JB Pritzker on June 16th, 2026, as part of the state's Fiscal Year 2027 budget. The fee actually takes effect on January 1st, 2027.
So what exactly is being taxed?
Your personal social media account isn't being taxed. Your data isn't being taxed directly, either. Instead, the law charges qualifying social media companies based on the number of Illinois users from whom the platform collects data during the month.

And the bigger Illinois userbase, the bigger the monthly fee.
Platforms with more than 100,000 users but no more than 500,000 will pay 10 cents per month for each user over 100,000.
For platforms with more than 500k but no more than 1M users, the fee is $40,000 plus 25 cents for each user over 500k.
And for platforms hitting over 1M users, it's $165,000 plus 50 centers for every user over 1M.
This is different from a typical tax based on how much money a company makes.

The state's new social media platform fee isn't calculated from a company's advertising revenue or income, either. It's essentially tied to the size of its Illinois audience and the data the platform collects form those users.

The law also says companies can't simply charge Illinois users more or give them fewer features to recover the cost of the fee based on their location.
So if you've been wondering, "Am I going to get a new social media charge somehow," not directly. The fee goes after the social media platform themselves. But whether companies ultimately find other ways to absorb or offset that cost is something users may want to keep an eye on when the fee takes effect in 2027.
